Wander Fuca – Terms of Service

These Terms of Service ("Terms") govern your membership, account, and use of the Wander Fuca coworking space and website (wanderfuca.com) (collectively, the "Space"). By creating an account, signing up for a membership, or using the Space, you agree to these Terms. If you do not agree, you may not use the Space.
1. Overview
Wander Fuca is a shared coworking space that provides access to workspace, amenities, and community. Membership grants use of the physical space only and does not imply endorsement, sponsorship, partnership, or affiliation between Wander Fuca and any member's business, organization, or activities.
2. Membership & Account
Memberships are month-to-month and may be cancelled by either party with 15 days' written notice.
Access hours and amenities vary by membership type, as described at the time of signup.
You are responsible for maintaining accurate account and billing information.
You are responsible for securing the space and using access systems (keycards, codes, etc.) appropriately, and for any activity that occurs under your account or access credentials.
Wander Fuca may suspend or terminate a membership for violation of these Terms, non-payment, or conduct that creates legal, safety, or reputational risk to the Space or other members.
3. Billing & Payment
By maintaining an active membership, you authorize Wander Fuca to charge your payment method on file according to your membership plan's billing cycle.
Fees are non-refundable except as required by law or expressly stated at signup.
Failure to pay may result in suspension or termination of access.
You are responsible for keeping your payment information current and for any fees resulting from failed or declined payments.
4. Use of Address
Members may use the Wander Fuca address solely for receiving food deliveries.
The Wander Fuca address and name may not be used:
As the registered office, business address, "homebase," or place of operation for any business, organization, or activity that a member owns, operates, or works for
As a legal, fiscal, or organizational representative address
In any way that suggests endorsement, sponsorship, partnership, or affiliation with Wander Fuca
For advocacy, political, fundraising, or legally representative activities, without prior written approval
Wander Fuca reserves the right to request removal of its name or address from any external communication if, in its reasonable judgment, continued use creates legal, reputational, or operational risk.
5. Guests
Members may host occasional guests during normal business hours, provided the member is present and responsible for their guest while in the Space.
Guest access is intended to be minimal and infrequent. Repeated or regular guest use, or use resembling ongoing workspace access, may require the guest to obtain their own membership.
After-hours guest access requires prior approval from Wander Fuca.
6. Children
Wander Fuca is a workspace intended primarily for adult members. Children may be permitted in the Space on a case-by-case basis and require advance notice to and approval from Wander Fuca before being brought in. Members remain fully responsible for the supervision, conduct, and safety of any child they bring into the Space.
7. Pets & Service Animals
Small, well-behaved dogs may be permitted in the Space on a case-by-case basis and require advance notice to and approval from Wander Fuca before being brought in. Approval may consider factors such as size, behavior, and the presence of other members. Members are responsible for their dog's behavior and any damage or disruption caused.
Separately, and regardless of Wander Fuca's general pet policy, trained service animals are permitted in the Space in accordance with the Washington Law Against Discrimination (RCW 49.60.215) and related state and federal law, including service animals still in training. Staff may ask only (a) whether the animal is required because of a disability and (b) what task it is trained to perform, and will not request documentation or a demonstration of training.
Emotional support animals, which provide comfort but are not trained to perform a specific task, are not guaranteed the same public access rights under Washington law and will be handled under Wander Fuca's general pet approval process above.
8. Neutrality & Discretion
Wander Fuca operates as a neutral, shared space. The views, actions, and communications of individual members do not represent Wander Fuca. Wander Fuca reserves the right, in its reasonable judgment, to request removal of its name or address from any external communication, or to take other appropriate action, if continued use creates legal, reputational, or operational risk.
9. Member Conduct
Members agree to:
Comply with all applicable laws in their use of the Space
Treat other members, guests, and staff with respect
Refrain from illegal, harassing, dangerous, or disruptive conduct
Use shared amenities and common areas responsibly
Wander Fuca reserves the right to suspend or terminate access for conduct that violates these Terms or disrupts the community or operation of the Space.
10. Liability & Responsibility
To the fullest extent permitted by law, Wander Fuca is not responsible for loss, damage, theft, or injury to persons or property while using the Space. Members are responsible for their own activities, communications, and compliance with applicable laws, and are encouraged to maintain appropriate insurance coverage (including general liability and property insurance, as applicable).
Limitation of Liability. To the maximum extent permitted by law, Wander Fuca and its owners, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising out of or related to your use of the Space, whether based on contract, tort, or any other legal theory, even if advised of the possibility of such damages.
Indemnification. You agree to indemnify and hold harmless Wander Fuca, its owners, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Space, your violation of these Terms, or your violation of any law or third-party right.
11. Termination
Either party may terminate a membership with 15 days' written notice, as described in Section 2. Wander Fuca may terminate or suspend access immediately for violations of these Terms, non-payment, or conduct that poses a safety, legal, or reputational risk. Upon termination, your right to access the Space ends, and any outstanding fees remain due.
12. Changes to These Terms
Wander Fuca may update these Terms from time to time. The "Last Updated" date above reflects the most recent revision. Continued use of the Space or maintenance of an active membership after changes take effect constitutes acceptance of the updated Terms. Material changes will be communicated to members through the account or billing relationship (e.g., by email).
13. Governing Law & Disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or your use of the Space will be subject to the exclusive jurisdiction of the state and federal courts located in Washington State, unless otherwise required by applicable law.
14. Privacy
Your use of the Space and website is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
15. Entire Agreement
These Terms, together with the Privacy Policy and any membership plan details provided at signup, constitute the entire agreement between you and Wander Fuca regarding your use of the Space, and supersede any prior agreements or understandings.
